Terms and Conditions

 

UNDERTAKING

Zulwini Tours and Safaris undertake to provide all services offered subject to the terms and conditions set out herein, which terms and conditions are accepted by the client.

RESERVATIONS

Reservations must be made in writing to the Zulwini Tours and Safaris office.  Upon confirmation by Zulwini Tours and Safaris, the reservation becomes binding and the terms and conditions as contained herein become enforceable.

CHECK-IN TIME

Clients shall check in at all departure points at least 15 minutes before the scheduled departure time.  Zulwini Tours and Safaris does not accept any responsibility for any client who fails to comply with this condition.

TOUR PRICES

Prices are detailed in the separate Rates List and are subject to alteration without prior notice.  Prices are also subject to adjustment in the event of increases in Value Added Tax, fuel prices and airfares or accommodation charges.  No adjustments will be made once full pre-payment has been received.

All prices and rates quoted in Rand, unless otherwise specifically agreed.  Payment in foreign currency will be accepted at the rate of exchange applied by the bankers of Zulwini Tours and Safaris at the time of receipt of payment.  Any shortfall from exchange rate fluctuations will be for the account of the client.

PAYMENT

A 25% deposit is required to secure the booking within 14 days of the reservation being made with the balance due 45 days prior to the tour departing. Bookings made within 45 days of departure must be accompanied by full payment.  We reserve the right to cancel any tour, if payment is not received within the specified time.

CANCELLATIONS

Cancellations shall only be valid if received by Zulwini Tours and Safaris in writing and shall be effective on the day of receipt in our office.  The following cancellation charges apply:
45-31 days before departure – 25% (75% refund)
30 to 16 days before departure – 50% (50% refund)
15 days or less before departure the full fare.
For any changes to confirmed reservations there is R100 booking amendment fee per change.

CHILDREN’S DISCOUNT

Long distance tours :
12 years and under sharing a room with 2 adults – 50%
Full and half day tours :
12 years and under accompanied by an adult – 50%

LAW AND JURISDICTION

The law of the Republic of South Africa shall govern the relationship between Zulwini Tours and Safaris and its clients.

The parties consent to the jurisdiction of the Magistrate’s Court in respect of any dispute, action or proceedings, which may arise between Zulwini Tours and Safaris and the client.

TRAVEL INSURANCE

We carry compulsory motor vehicle insurance and a comprehensive motor accident policy.  Clients are strongly recommended to take out comprehensive insurance cover before travel with protection for the full duration of the tour, to cover personal injury, medical expenses, loss of luggage and the expenses associated with cancellation or curtailment of a tour.

TRAVEL DOCUMENTS

It is the responsibility of the client to be in possession of a valid passport, visa permits, vaccination and other medical certificates where applicable, and all other travel documents.  Zulwini Tours and Safaris does not accept any responsibility for the failure of a client to obtain the necessary travel documents.

LIABILITY AND RESPONSIBILITY

Neither Zulwini Tours & Safaris, nor any person acting for, through or on behalf of it, shall be liable for any loss or damage whatsoever and without restricting the generality of the foregoing shall particularly not be responsible for loss or damage arising from any errors or omissions contained in it’s brochure or other literature, late or non confirmation or acceptance of reservation, loss or damage caused by delays, accidents, sickness, injury or death, whether occasioned by negligence or not with the exception of gross negligence on the part of Zulwini Tours and Safaris or its duly authorised employees.

Client’s bookings are accepted on the understanding that they appreciate the possible risks inherent in adventure travel and that they undertake the tours, safaris, river trips, trails and expeditions featured in this brochure at their own risk.  While every precaution is taken to ensure the safety of clients participating on the tour, Zulwini Tours & Safaris does not hold itself responsible for death or any injury or loss which might occur to such person, sustained from any cause whatsoever, excluding gross negligence.

WILD ANIMALS

Clients may come into close physical contact with wild animals during tours or trails.

HEALTH

The client acknowledges being aware of the proposed itinerary and hereby confirms that he or she is medically fit, in good health and is able to embark upon the tour.  Any client with a pre-existing medical condition or illness must declare the true nature of such condition at the time of booking.  Zulwini Tours & Safaris cannot be held responsible for the provision of drugs or treatment which may be required during the tour.

MALARIA

Visitors to Mpumalanga, Mozambique, Zimbabwe and Botswana as well as the game reserves of Kwa-Zulu Natal, are advised to consult with their doctor regarding the taking of anti-malaria medication.

ALTERATIONS

All tours, charters, hire, itineraries, travel arrangements, hotel accommodation and other arrangements are subject to alterations or cancellations at any time without prior notice and for any reason including but not restricted by weather, avalanches, strikes, war, government interference  or any other cause whatsoever at the sole and absolute discretion of Zulwini Tours & Safaris.  Zulwini Tours & Safaris shall not be responsible for any damages whatsoever arising from such alteration or cancellation.

ACCOMMODATION

Accommodation is as specified in the itinerary or brochure.  The use of specific accommodation is subject to availability. Zulwini Tours and Safaris reserves the right to make use of alternate accommodation.  This will in no way affect the price of the tour.

TRANSPORTATION

Transportation is in air-conditioned vehicles or as specified with size appropriate to requirements of the tour.  Vehicles provided are large enough to accommodate the number of passengers and luggage.  All drivers are licensed in terms of SA legislation.  All vehicles comply with relevant safety regulations.  Zulwini Tours & Safaris reserves the right to utilise different sizes or types of vehicles to those indicated depending on demand and availability.

DELAYS

Zulwini Tours & Safaris shall not be responsible for the consequences of any delays whether arising from accidents, breakdowns or any other cause.
